NIGHTFALL AUTOMOTIVE LTD – TERMS OF SERVICE
1. Agreement
By booking or using any service provided by Nightfall Automotive Ltd, you confirm that you have read, understood, and agreed to these Terms of Service. These terms define the responsibilities of both Nightfall Automotive Ltd and the customer.
2. Definitions
Nightfall Automotive Ltd: Provider of vehicle tuning, diagnostics, remapping, and testing services.
Customer: Any individual or entity using our services.
Services: Any tuning, diagnostics, remapping, emissions-related work, or testing carried out by Nightfall Automotive Ltd.
3. Vehicle Condition & Customer Responsibility
You confirm that your vehicle:
Is fully maintained in line with manufacturer specifications
Is roadworthy, taxed, MOT’d, and safe to operate prior to work
Has no undisclosed mechanical, electrical, or emissions-related faults
Nightfall Automotive Ltd accepts no responsibility for issues arising from poor maintenance, pre-existing faults, or undisclosed modifications.
4. Risk Acknowledgement
All tuning, testing, and remapping services are carried out entirely at the customer’s own risk. Performance modifications increase mechanical and thermal stress and may expose existing weaknesses.
5. Warranty
A lifetime warranty applies to ECU software only
No warranty is provided for mechanical or electrical components
Warranty is void if the vehicle is modified, repaired, or tuned elsewhere
Excluded Components (No Warranty)
Including but not limited to:
Clutch
DPF
Turbocharger
Gearbox
Intercooler & boost hoses
Any modified or aftermarket components
6. Mechanical Failure & Liability
Nightfall Automotive Ltd accepts no liability for mechanical failures occurring before, during, or after services. Responsibility for vehicle condition remains solely with the customer.
7. Health Checks & Remapping Risks
Health checks are recommended but optional. Proceeding without one is done entirely at the customer’s risk. Performance outcomes may vary, and accelerated component wear may occur following tuning.
8. Deposits & Cancellations
Deposits are non-refundable
A minimum of 24 hours’ notice is required for cancellations or rescheduling
Deposits are forfeited if the vehicle cannot be tuned due to faults or prior tuning
Where no deposit is taken, a £50 charge may apply if the vehicle is untunable
9. Testing & Safety
All testing is carried out under real-world conditions. Customers must follow all safety instructions. Failure to comply will result in immediate termination of testing.
10. Unexpected Issues
If programming or software issues arise, repair times may be outside our control. Nightfall Automotive Ltd is not responsible for any associated costs, including travel, recovery, or downtime.
11. Emissions System Modifications – Legal Status & Liability
Non-Road Use & Absolute Customer Responsibility
Any work carried out by Nightfall Automotive Ltd involving the modification, calibration, disabling, bypassing, suppression, removal, or deactivation of any emissions-related system or function — including but not limited
to Diesel Particulate Filters (DPF), Exhaust Gas Recirculation (EGR) systems, AdBlue / SCR systems, catalytic converters, emissions sensors, or associated ECU software strategies — will render the vehicle non-roadworthy
and unlawful for use on public roads.
By requesting, authorising, or permitting such work, the customer expressly acknowledges, understands, and agrees that:
The vehicle will not comply with UK road traffic law, MOT requirements, construction and use regulations, emissions legislation, or insurance conditions.
The vehicle is modified and released strictly for off-road, motorsport, export, diagnostic, or testing purposes only.
All responsibility for legality, roadworthiness, insurance validity, MOT compliance, registration status, and vehicle use rests solely and entirely with the customer.
Nightfall Automotive Ltd accepts no liability whatsoever for fines, penalties, prosecutions, MOT failure, insurance invalidation, vehicle seizure, impoundment, destruction, or any resulting losses or damages.
The customer agrees not to use the vehicle on public roads where such modifications are prohibited.
No representations, warranties, or assurances are given or implied regarding legality or emissions compliance following such modifications.
Nightfall Automotive Ltd does not provide legal advice and expressly disclaims any duty to advise on emissions compliance or road legality.
12. Indemnity
The customer agrees to fully indemnify and hold harmless Nightfall Automotive Ltd from any and all claims,
actions, penalties, losses, damages, costs, or liabilities arising directly or indirectly from:
The services provided
Emissions-related modifications
The use, operation, or legality of the vehicle
13. Acceptance
By proceeding with any service, the customer confirms that they:
Have read and understood these Terms of Service
Accept all risks associated with vehicle tuning and emissions modifications
Acknowledge that emissions-related work renders the vehicle non-roadworthy
Accept full legal, financial, and criminal responsibility for the vehicle’s use
